Agreement to Terms

By accessing and using the services of Digital Presence Co. ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services

We provide custom website design and development services for businesses. Our standard package includes 5 custom pages, mobile-responsive design, custom animations, SEO setup, contact forms, 2 rounds of revisions, and 30 days of post-launch support.

Pricing and Payment

  • Total Cost: Our standard website package is $1,200.
  • Payment Structure:
    • 20% down payment ($240) - Due after first design render
    • 50% payment ($600) - Due after main development approval
    • 30% final payment ($360) - Due upon project completion
  • Refund Policy: If you are not satisfied with the initial design, we will refund all payments except the initial 20% deposit, which covers design work already completed.
  • Additional Costs: Domain registration (approximately $15-20/year) is not included and is the client's responsibility.

Timeline

Our standard timeline is 2 weeks from project kickoff to launch. This timeline assumes timely provision of all required content (text, images, branding) by day 2. Delays in content delivery will extend the timeline accordingly.

Client Responsibilities

As the client, you agree to:

  • Provide all necessary content (text, images, branding, logos) within agreed timeframes
  • Participate in scheduled meetings and provide timely feedback
  • Review and approve designs and development milestones within 48 hours
  • Make payments according to the agreed schedule
  • Register and maintain your own domain name

Intellectual Property and Ownership

Upon full payment, you will own all rights to the completed website, including all code, design files, and assets. You are free to modify, host, or transfer the website as you see fit. We retain the right to showcase the completed project in our portfolio unless otherwise agreed.

Revisions

Our standard package includes 2 rounds of revisions during the design phase. Additional revisions beyond this may incur additional fees. Revisions must be requested within the project timeline to avoid delays.

Post-Launch Support

We provide 30 days of post-launch support for bug fixes and technical issues. This does not include new features, content updates, or design changes. After 30 days, ongoing maintenance packages are available separately.

Hosting

We will set up your website on free hosting platforms (Vercel or Netlify) at no additional cost. You are responsible for any future hosting costs if you choose to migrate to a different provider.

Warranties and Disclaimers

We warrant that all work will be performed in a professional manner consistent with industry standards. However, we do not warrant that the website will be error-free or uninterrupted. Websites are provided "as is" without warranty of any kind.

Limitation of Liability

Our total liability for any claims arising from our services shall not exceed the total amount paid by you for the services. We are not liable for any indirect, incidental, or consequential damages.

Termination

Either party may terminate the project with written notice. If you terminate after work has begun, you will be charged for work completed up to the termination date. Refunds will be provided according to our refund policy.

Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of the modified terms.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
